1. Acceptance of Terms

By downloading, installing, or using Kendibah ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms constitute a legal agreement between you and Erik Jimenez ("we," "our," or "us"), the developer and publisher of Kendibah.

2. Description of Service

Kendibah is an iOS and watchOS application that finds supported Roku and Samsung TVs on your local network and controls them directly, using the control interfaces those TVs offer on the local network.

What Kendibah can do depends on your TV's model, software and settings. Some features need a setting turned on in the TV, such as Roku's "Control by mobile apps." TV makers can change or turn off these interfaces at any time, which may limit or stop some features. We do not guarantee that any particular TV or feature will work.

3. Eligibility

You must be at least 13 years of age to use Kendibah. By using the App, you represent that you meet this requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agrees to these Terms on your behalf.

4. Free Trial and Lifetime Purchase

Finding, pairing, and managing TVs is free. Controlling a TV needs either an active free trial or the Lifetime purchase.

• The free trial is a free in-app purchase. It starts only when you tap Start 7-Day Free Trial and lasts 7 days. It does not automatically convert to a purchase and never charges you.
• When the trial ends, TV control stops until you buy Lifetime. Finding, pairing, and managing TVs stay free.
• Each Apple Account can start the trial once. Reinstalling the App does not start a new trial.
• Lifetime is a one-time purchase that unlocks TV control with no subscription. You can buy it during the trial or without starting the trial.
• Purchases are processed by Apple and charged to your Apple Account. Use Restore Purchases in the App to restore them on another device signed in to the same Apple Account.

Prices are set in the App Store and may vary by region. Refund requests are handled by Apple in accordance with its refund policies.

5. Your Data

Kendibah stores your TV list, your settings, and your TV pairing on your devices. We do not collect, access, or store this data on any server. Deleting the App may remove this data from your device.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Use the App to control TVs, or use networks, that you are not authorized to control or use
• Attempt to reverse engineer, decompile, or disassemble the App
• Redistribute, sublicense, or resell the App or any part of it

7. Trademarks and Affiliation

Kendibah is an independent app. It is not made, endorsed, or sponsored by, or affiliated with, Roku, Inc. or Samsung Electronics Co., Ltd. Roku is a trademark of Roku, Inc. Samsung, The Frame, and SmartThings are trademarks of Samsung Electronics Co., Ltd. Apple, iPhone, and Apple Watch are trademarks of Apple Inc. These names are used only to describe which TVs the App works with.

8. Intellectual Property

All content, design, and code of Kendibah are the property of Erik Jimenez or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms and Apple's App Store terms.

9. Disclaimer of Warranties

Kendibah is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, compatible with your TV, or free of harmful components. Commands depend on your network and your TV, and may be delayed, missed, or carried out differently by the TV.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Erik Jimenez shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to damages related to your TV, your network, or other devices.

Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Third-Party Services

Some features open Roku's website or Samsung's SmartThings app. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service or of your TV's software.

Your use of Kendibah is also subject to Apple's Standard End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of Kendibah after any changes constitutes acceptance of the updated Terms.

13. Termination

You may stop using Kendibah at any time by deleting the App. We reserve the right to suspend or terminate your access to the App if you violate these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
